CONSTITUTION OF “VISHVA SHAKTI PARTY”
ARTICLE I : NAME OF THE PARTY
The name of the party shall be “VISHVA SHAKTI PARTY” hereinafter referred to as “The Party” and this constitution may be called the Constitution of “VISHVA SHAKTI PARTY”.
ARTICLE II : OBJECTIVES OF THE PARTY
The Party is committed to build a modern, prosperous and strong India which ensures equality, peace, progress, total justice, refined democracy, welfare socialism, economic well being, and harmony, safety and security, national unity and True Secularism.
That, the party, will not, in any manner, promote or instigate or participate in violence.
ARTICLE III : MEMBERSHIP OF THE PARTY
Any Indian citizen over 18 years of age who has faith in the objectives, principle and policies of the party and its Constitution, can become a member of the party by fulfilling requirements of membership. There should not be, any criminal case, pending against the person at the time of taking membership of this party. However the National Executive of the party may consider membership of any such person in the interest of country in exceptional case only. They should also be supporter of Anna Hazareji for his movement against corruption and Swami Ramdevji for his movement against black money. There will be life member, ordinary member and active member and it is only the active members who will be given opportunity to contest election and for other post on priority basis.
ARTICLE IV : ORGANS OF THE PARTY (ORGANIZATIONAL STRUCTURE)
Organizational structure of the Party shall be as follows:
  • Patrons
  • Advisory and Decision Making Body
  • National Executive
  • State / UT Executive
  • Zone Executive
  • Loksabha Executive
  • District / City Executive
  • Vidhansabha Executive
  • Block Executive
  • Village/ Ward Executive

All the executives at different level shall consist of Advisory and Decision Making Body, President, Vice-President, General Secretary, Secretary, Treasurer and executive members (to whom different responsibility may also be given)
The number of executives on each level will be 30.
The size of all the executives at all the levels can be expanded by resolution passed by the office bearers and executive members of the Concerned Executive, which may be nominated at initial stage of formation of Executive Body and thereafter elected at particular interval. Other associations and fronts may also be created by the National Executive on the advice of Advisory and Decision Making Body. The national executives may create different division or prakosth to run the organization smoothly namely:

  • Advocate / legal
  • Engineer
  • Medical
  • CA / accountant/ finance
  • Management
  • Computer
  • Teacher
  • Shop-keeper
  • Media
  • Marketing
  • Agriculture
  • Labour
  • Industry
  • NGO
  • writers
  • Cinema (movie / drama / television)
  • Dance / music or any other division.
PATRONS :
All the five founder national office bearers i.e. President, Vice – President, General Secretary, Secretary and Treasurer will be the patrons of this party for lifetime. They may be contacted later on to know about situation and circumstances of the party at the time of formation by the existing national executives.
ARTICLE V : OFFICE BEARERS OF THE PARTY


ADVISORY AND DECISION MAKING BODY

It will consists of all the EX-PRESIDENTS of the party on various levels who will advise their executives and will also be in the decision making process along with executives in their concerned level.

THE PRESIDENT
The President shall :
  • Preside over the sitting / meetings of the concerned executive / association or the front.
  • Conduct election of office bearers of the concerned executives / association / front.
  • Decide date of executives / associations / fronts meeting.
  • Appoint Presidents / Conveners of various associations and fronts.
  • Allocate the work and duties among the office bearers / association and fronts.
THE VICE – PRESIDENT
  • In the absence of President, the Vice-President specially authorized by the President shall preside over the meeting and carry out all the functions of the President.
  • To carry out responsibilities as directed by the President.
  • In emergent circumstances like resignation / termination / expulsion / death etc. of President, the vice-president can work as acting president till a period of three months or till the elected president resume the charge of his / her office which ever is earlier.
THE GENERAL SECRETARY
  • As per the instructions of President, the General Secretary shall convene meetings, issue circulars and fix agenda.
  • He/She shall organize the meetings and maintain the minutes and reports of meetings and circulate them among the members.
  • He/She shall run Office of the Party and make necessary appointments with the consent of the President
  • He/She shall organize programmes, meetings, Conferences, agitations and look after publicity. He/She may also execute the decision of the President / the Executive.
SECRETARY
  • To assist the General Secretary in his duties for discharging function allocated by the President.
  • In emergent circumstances like resignation / termination / expulsion / death etc. of General Secretary, the Secretary can work as acting General Secretary till a period of three months or till the elected General Secretary resume the charge of his / her office which ever is earlier.
TREASURER
  • To maintain the Income and Expenditure Account of the Executive /Association / Front.
  • To get the accounts examined / audited and to report the same to the executive annually.
  • To audit the account of all sub-ordinate units.
EXECUTIVE MEMBER
  • He will work on the matters assigned by the president.
METHOD OF APPOINTMENT OF OFFICE – BEARERS:
The office bearers (executive) at different level may be elected on following way
  • Village/ward executive- all the members of village /ward will elect its executive among then self by voting.
  • Block executives:- It will be elected by block council consisted of all existing block executive and president of all village/ward coming under that block area.
  • Vidhansabha executive :- It will be elected by vidhansabha council consisted of existing all vidhansabha executive and all president of blocks coming under that vidhansabha area.
  • District/city Executive :- It will be elected by District /City council consisted of all existing District/ City executives and president of vidhansabha executives coming under that District/ City area.
  • Loksabha Executive:- It will be elected by Loksabha council consisted of all existing loksabha executive and president of all District/ City coming under that Loksabha area.
  • Zone Executive:- It will be elected by zone council consisted of all existing zone executive and all president of Loksabha coming under that zone area.
  • State Executive: - It will be elected by state council consisted of all existing State executive and all president of zone coming under that State area.
  • National Executive:- It will be elected by National council consisted of all existing National executive and all president of all the states. Executives may also be nominated by the concerned President for three months only.
TERM :
The term of all the executives i.e. their office bearers and executive members shall be one year. But the term of first executives i.e. office bearers and executive members will be up to one year or till registration of the party which ever is later and thereafter election may be conducted. The executive can not be re-elected or nominated for the same post for next consecutive year and there should be at least one year gap for re-election or nomination for the same post, except for the post of executive members.
NOMINATED post will be for maximum period of three months.That it declares party will not, in any manner, promote or instigate or participate in violence.
That it declares party must contest an election conducted by the election commission within five years of its registration and hereafter should continue to contest. (if the party does not contest elections continuously for six years the party will be taken off the list of registered parties.)
ARTICLE VI : RULES OF DISPUTE RESOLUTION & DISCIPLINE
BREACH OF DISCIPLINE
Breach of discipline includes the following:
  • Acting or carrying on propaganda against any programme or decision of the Party.
  • To act contrary to the declared policies of the Party.
  • To spread ill-feelings among members and obstruct the working of the party in any way.
  • Violating any rule or disobeying any order passed by a competent authority of the Party.
  • Taking a party dispute to any other agency outside the party including print and electronic media.
  • To misappropriate the funds of the Party.
  • To join a party or a group or an association, not recognized by the Party or whose principles are not approved by the National Executive.
  • To misuse the authority vested by virtue of being an office bearer or executives of the party or fail to use such authority for functioning of the constituent of the Party.
  • To oppose an official candidate set up by the party in any election or to do any sort of work intentionally which damage the party in any way.
  • Any other work which is illegal and injurious to party and harmful for the nation in opinion of National Executive.
PUNISHMENT FOR BREACH OF DISCIPLINE:
Any member guilty of breach of discipline shall be liable for one or more Punishment written below:
  • Removal from office.
  • Suspension from membership.
  • Expulsion from the party which may be permanent.
  • Imposition of disability to hold office which may be for a specific period or permanent.
DISPUTE RESOLUTION BODY
Any person charged with indiscipline may be tried by State / UT Executive first and then its appeal may be heard by the National Executive whose decision will be final. However, the National Executive can directly take cognizance of any case of indiscipline. The decision may be taken by 2/3 majority of executives.
ARTICLE VII : BASICS OF RULES OF CONDUCT OF BUSINESS
DECISION MAKING PROCESS:
Decision shall be taken by concerned executives at different levels by majority. Advisory and Decision Making Body will also help other executives in this regard by providing his / her / their valuable opinion and will also be part of making decision.
MEETING:
  • National Executive- expected, at least once in two months, if no meeting held For consecutive four months (120 days), then national executive may be considered abolished and fresh election may be considered.
  • State Executive and Zone Executive - expected , at least once in 25 days, if no meeting held for consecutive three months (90 days), then state executive may be considered abolished and fresh election may be considered.
  • Loksabha Executive- expected , at least once in 20 days, if no meeting held For consecutive two months (60 days), then that executives may be considered abolished and fresh election may be considered
  • District Executive, Vidhansabha Executive – expected at least once in 15 days if no meeting held for consecutive 45 days, then that executives may be considered abolished and fresh election may be considered.
  • Block Executive and Village / Ward Executive - expected , at least once in 7 days, if no meeting held For consecutive 30 days, then that executives may be considered abolished and fresh election may be considered.
    There will be no emergent meeting, for expulsion of, any member, from the party.
QUORUM :Quorum for all executive meetings shall be one-third.
NOTICE :
  • For emergent meeting, 72 hours notice is required to be given.
  • For ordinary meeting, a notice of a week’s time is required.
  • For General Body Meeting, two week’s time is required.
ARTICLE VIII: PARTY FUNDS & ACCOUNT
  • FFor fund collection, receipts will be printed at the National and State / UT levels only.
  • Receipts in book form containing 20 receipts will be duly numbered.
  • Each receipt shall bear a facsimile signature of concerned Treasurer.
  • The counterfoil of the receipt will be signed in full by the member who collects the money.
  • Bank account will be opened in the name of party at National, State / UT and District / City level and to be operated by President, General Secretary and Treasurer jointly of the concerned unit.
  • Fund distribution for National unit shall be 30%, and for other level executive 10% each.
  • That the party shall submit it’s audited annual financial statement to the commission within a period of 60 days after the end of each financial year and the audit of the party account will be conducted by an auditor empanelled with the CAG. That the fund of the party will be used for political purpose only and the party will abide by the instructions issued by the commission from time to time in the maintenance of its accounts.
ARTICLE IX : PARTY CONSTITUTION’S AMENDMENT PROCEDURE
The amendment of Constitution of Party can be made by approval of general body of the party provided it will not harm the aims and objectives of the Party.
ARTICLE X : MERGER, SPLIT AND DISSOLUTION PROCEDURE
For all these, steps may be taken by Central Council in the best interest of the Party or the Country by 2/3 majority of existing strength of central council and by the general body of the party with simple majority provided it will not harm the aims and objectives of the Party.
ARTICLE XI : MANDATORY PROVISION UNDER SECTION 29 a (5) OF RP ACT 1951
The VISHVA SHAKTI PARTY shall bear true faith and allegiance to the constitution of India as by law established and to the Principles of Socialism, Secularism and Democracy and shall uphold the Sovereignty, Unity and Integrity of India. .
